§ 82-501. Applicability.

  • (a)

    The following provisions shall apply to any residential swimming pools (as defined in section 82-511) constructed after the effective date of the Residential Swimming Pool Safety Act (F.S. ch. 515) (October 1, 2000):

    (1)

    All swimming pools shall be constructed in accordance with the requirements of the "Residential Swimming Pool Safety Act," (F.S. ch. 515), or the Florida Building Code.

    (2)

    All residential swimming pool safety feature options and residential swimming pool barrier requirements required on swimming pools constructed under the "Residential Swimming Pool Safety Act," or the Florida Building Code shall be maintained by the owner or occupant following construction.

    (b)

    The provisions of division 2 shall apply to any swimming pools constructed before the effective date of the Residential Swimming Pool Safety Act (October 1, 2000) and any swimming pool not subject to such Act (except as otherwise excepted in division 2).
