§ 82-371. Permit.

  • (a)

    Required; time limit for commencing work. No person shall excavate in a public street or alley without a permit. Work under such permit shall be commenced within 48 hours, otherwise the permit shall become void. All permits shall be kept at the place of excavation while the work is being done and shall be exhibited on request by any person having an authority to examine the permit.

    (b)

    Fee. No such permit shall be issued until the applicant pays a fee of $10.00 to the city.

    (c)

    Use of public property. It is expressly stipulated that this permit is a license for permissive use only and that placing of facilities upon public property pursuant to this permit shall not operate to create or vest any property rights in the holder.

    (d)

    Plans. The sketch covering details of excavations on file in the office of the city engineer shall be made a part of this permit. Additional sketches shall be furnished where the attached sketch is not applicable.
