§ 70-472. Charge for installation or change of water or electric service.

(a)

Generally. The following services will have charges imposed as detailed in Schedule A*:

(1)

Each application for service.

(2)

Each transfer of service from one location or address to another location or address.

(b)

Apartment transfer program. In lieu of the service charge set forth in subsection (a) of this section, a service charge as detailed in Schedule A* shall be made for each application for electric or water service or electric and water service by the owner of multiple-family residential units where apartment transfer program has been established under the provisions of this subsection.

(1)

This program shall be available to the owners of multiple-family residential units consisting of at least 48 units.

(2)

To participate in this program, the owner must first enter into a written agreement with the city providing that:

a.

Upon the termination of service to individual tenants of the units, the service shall automatically transfer into the name of the owner.

b.

The owner agrees to pay all utility charges for the transferred service: after it has been transferred into the owner's name; and until the owner requests that service be terminated or a new tenant requests that service be transferred into its name.

c.

The obligations of the owner shall continue until the owner delivers written notice of the owner's termination of the agreement to the city, but such termination shall have no effect on the owner's obligation to pay for service which has been transferred into the owner's name prior to the city's receipt of such notice.

(3)

The service charge under the apartment transfer program shall apply only to the transfer of service to the owner. Applications by tenants or other occupants of the multiple-family residential units shall be governed by subsection (a) of this section.

(c)

Time for payment; additional charge; identification. The service charge can be paid at the time of application or may be billed with the first monthly bill rendered. Applicants applying for service after 2:00 p.m., will have installation completed on the next business day. Applicants who apply for service between 2:00 p.m. and 4:00 p.m. and who request same-day service will be charged an additional fee as detailed in Schedule A*. Applicants who request the personal credit check allowed by section 70-683 will be charged an additional fee as detailed in Schedule A*. Positive identification may be required of the customer with each application in accordance with the provisions of section 70-4.
