§ 59-9. Regulations within the parking exempt zone.

  • (a)

    Newspaper dispensers placed in the parking exempt zone, as defined in section 122-981 of this code, shall be subject to all of the previously stated regulations in this chapter with exception to the following additional requirements listed below.

    (1)

    Each rack, or group of newspaper racks, on public right-of-way shall be separated by a 400-foot radius from any other rack or group of newspaper racks, on public right of way.

    (2)

    Each rack, or group of newspaper racks, on private property shall be separated by a 400-foot radius from any other rack, or group of newspaper racks, on the same private property.

    (3)

    A newspaper dispenser adjacent to a curb line shall be placed parallel to the street and shall dispense publications on the pedestrian side of the public right of way.

    (4)

    A newspaper dispenser shall not be placed within three feet of any marked crosswalk.

    (5)

    A newspaper dispenser shall not be placed within five feet of any fire hydrant, standpipe connection, fire call box, police call box or other emergency facilities.

    (6)

    A newspaper dispenser shall not be placed within three feet of the end of any bus bench.

    (b)

    A newspaper dispenser shall not be placed on any public land improved with lawn, flowers, shrubs, trees or other landscaping.

    (c)

    A newspaper dispenser shall not be placed in any manner which endangers the safety of persons or property.
