§ 58-51. Procedure for abandoning streets.

  • (a)

    Application. Any interested party or adjacent or adjoining owner desiring that the city vacate, abrogate, quitclaim or abandon any platted, dedicated or acquired easement for streets, alleys or other rights-of-way shall make application therefor to the planning and zoning commission on forms to be approved by the commission. Such application shall contain the name and address of the applicant, the legal description of the property to be vacated and abandoned or quitclaimed by the city, the names and addresses of all adjacent property owners affected thereby, the purposes for which the application is made, a legal description of the property, a survey sketch prepared by a Florida licensed land surveyor and certified to the city, and such other information and data as may be required by the commission.

    (b)

    Investigation and hearing. The commission, upon receipt of the application, shall cause such investigation to be made as it may require and call a public hearing upon the application at the earliest convenience. Notice of the public hearing upon the application shall be published one time in a newspaper of general circulation in the city at least ten days prior to the date of the hearing. The notice shall contain a legal description of the property involved, the date, time and place of the public hearing to be held, and such other information as the commission shall require. Notice of the public hearing shall also be mailed to the last known addresses of the property owners adjoining the property involved.

    (c)

    Action by city council. Subsequent to the holding of a public hearing upon the application, the commission shall submit in writing its recommendation to the city council upon the application. The city council may then adopt, amend or reject the recommendations of the commission. No hearing shall be required before the city council upon its consideration of the recommendations of the commission.
