§ 58-5. Temporary closing of street, sidewalk or other public place.

  • (a)

    Generally. The city manager, director of public works, director of the sanitary sewer system, electric utility director, chief of police, fire chief, city engineer or traffic engineer is authorized to temporarily close any public street, alley, sidewalk, way or other public place to vehicular or pedestrian traffic, parking or other public use when in the opinion of any such officer it is necessary for municipal purposes or for the public benefit to do so, provided adequate signing and barricades are installed when required.

    (b)

    Authority to grant permits for use of closed areas. The city engineer is authorized to grant permits for the use of such closed areas for the following purposes and upon the following conditions:

    (1)

    The construction, reconstruction, installation, repair, replacement, relocation or removal of any public works, improvements, tracks, pipelines or utilities therein, thereon or thereunder, whether such work is performed by the city, the state, the county or other governmental body, board or authority, or any utility, or any contractor employed to do or perform the such work.

    (2)

    The holding of school carnivals, rallies, block parties, parades and or similar school activities when conducted under the auspices of the board or superintendent of schools of the county or of Central Florida Community College or similar officers, boards or institutions.

    (c)

    Contents of permit; notification of city officials. All permits issued shall state the specific purpose for which the permit is granted and shall accurately describe the parts of the street, alley, sidewalk, way or other public place to be closed and the exact time and the period of such closure. A copy of each such permit shall be promptly delivered to the city manager, chief of police and fire chief.

    (d)

    Unlawful entry on closed area. Any person operating a vehicle or any pedestrian using or attempting to use any street, alley, sidewalk, way or other public place which has been closed as provided in this section to vehicular and pedestrian traffic, parking or other public use shall be guilty of an offense.
