§ 54-38. Placement of residential waste for collection; collection plans.

  • (a)

    Selection of plan. A residential customer shall place its municipal solid waste in accordance with one of the following plans. The customer shall select one of these plans. Once selected, a choice shall remain unchanged for a minimum of six months. Any person who is physically unable to place a residential municipal solid waste container or refuse cart at the curb shall be entitled to have the municipal solid waste collected at the side or rear of the building at no extra charge.

    (1)

    Plan 1: Curbside, contained refuse; and curbside, separated, loose or contained yard waste.

    (2)

    Plan 2: Rear-door, contained refuse and curbside, separated, loose or contained yard waste. This Plan is no longer available for selection by new customers or existing Plan 1 customers upon adoption of the section. Plan 2 will officially be discontinued for all customers effective March 1, 2007.

    (b)

    Municipal solid waste collected according to Plan 2, except those customers in existence at the time of the adoption of the ordinance from which this chapter is derived, will not continue to receive this plan type collection by the city except upon a finding by the city manager set forth below.

    (1)

    Those Plan 2 customers in place at the adoption of the ordinance from which this chapter is derived shall have until March 1, 2007 to convert to Plan 1 after which time Plan 2 will automatically be discontinued and Plan 2 customers will receive Plan 1 service at the fee established by separate resolution.

    (2)

    The director may authorize the continued collection of municipal solid waste from rear doors only upon finding that one of the following conditions is met:

    a.

    No one living in the household from which the municipal solid waste is generated is able to physically move the refuse container from the house to the curb. In such case, a written statement signed by a physician attesting to this incapacity is required and departmental verification that no other member of the household exists that can perform this function.

    b.

    Approval by the director to receive Plan 2 service shall be made on a case-by-case basis upon written application of a property owner.

    (c)

    Plan 1. The following provisions apply to Plan 1:

    (1)

    Garbage shall be placed in a residential municipal solid waste container, or refuse cart assigned by the department, no earlier than 7:00 p.m. on the evening preceding the collection day, at a curbside location or alleyway within a distance of three feet from the traveled portion of the public street or alleyway adjacent to such premises in such a manner as not to interfere with or endanger the movement of vehicles or pedestrians. All residential municipal solid waste containers or refuse carts must be removed by 7:00 a.m. of the day following the collection day. Collectors shall not be required to lift any trash over fenced areas.

    (2)

    Yard waste may be placed loose or contained in a rigid reusable container or paper lawn and leaf bag and placed separately at a curbside location within three feet from the traveled portion of the public street adjacent to such premises in such a manner as to not interfere with or endanger the movement of vehicles or pedestrians. All reusable containers must be removed by 7:00 a.m. of the day following the collection day. Not more than 20 containers or paper bags may be set out per yard waste collection day. Yard waste must be placed for collection by 7:00 a.m. on the assigned collection day. Tree limbs and branches shall be cut to four-foot lengths and stacked neatly adjacent to and separate from other yard waste.

    (d)

    Plan 2. The following provisions shall apply to plan 2:

    (1)

    Garbage shall be placed in a residential municipal solid waste container by 7:00 a.m. and may be at the rear or side door of the residence. City employees shall not be allowed to enter the customer's house, carport, garage, porch or outbuilding, or enter into a fenced area where an unrestrained animal is present. Garbage must be easily removed by the employee. Cardboard boxes or other loose or bulky garbage that cannot be contained in a garbage bag must be placed at the curb for collection. Collectors shall not be required to lift any trash over fenced areas.

    (2)

    Yard waste may be placed loose or contained at a curbside location within three feet from the traveled portion of the public street to such premises in such a manner as to not interfere with or endanger the movement of vehicles or pedestrians. Yard waste must be placed for collection by 7:00 a.m. on the assigned collection day. All reusable containers must be removed by 7:00 a.m. of the day following the collection day. Tree limbs and branches shall be cut to four-foot lengths and stacked neatly adjacent to and separate from other yard waste.

    (e)

    Non-containerized waste. All municipal solid waste not placed in containers and which is placed at curbside for collection must be away from guy wires, overhead wires or cables, overhanging tree limbs, mailboxes, fences, meter covers, telephone switch boxes, utility poles, trees or other obstructions which would impair efficient pickup and removal.

    (f)

    White goods. White goods shall be collected for a fee as established by separate resolution. All airtight units shall have the doors removed before being placed for collection separately at a curbside location within three feet from the traveled portion of the public street adjacent to such premises in such a manner as to not interfere with or endanger the movement of vehicles or pedestrians. All stand-up items shall be laid flat. Scrap metal such as poles, pipes and antennas shall be cut or bent into pieces not longer than six feet. Refrigerators, freezers, air conditioners or any other appliance or white good containing refrigerants must be handled as special waste.
