§ 34-201. Littering generally; use of recycling containers; removal of waste generated by contractors, tree trimmers and similar businesses.

  • (a)

    As used in this section, the following terms have the following meanings:

    (1)

    Municipal solid waste means the property and material defined in section 54-1.

    (2)

    Recycling container means a container as defined in section 54-1.

    (3)

    Litter means municipal solid waste including, without limitation, sand, grit, petroleum products, lighted or unlighted cigarettes or cigars, flaming or glowing material, or other sidewalk accumulations.

    (b)

    No person shall throw, drop, sweep or place on any street, park, recycling dropoff center grounds, sidewalk, vacant or unoccupied premises, alley or public area, or private property any litter.

    (c)

    No person shall, while operating a motor vehicle, allow litter to fall from the vehicle.

    (d)

    It shall be unlawful to deposit municipal solid waste upon any vacant or unoccupied premises of the city, or upon any street, alley or park, or in any rock pit, pool or lake within the city.

    (e)

    It shall be unlawful to deposit any item in a recycling container other than the type of items labeled on the container or on applicable signs erected on the site.

    (f)

    It shall be unlawful for commercial parking lot maintenance personnel, tree trimmers, landscapers, construction or demolition contractors, and lawn maintenance operators to fail to properly dispose of all municipal solid waste produced by their operations in a licensed and permitted fill. The waste they remove from the site shall be only the waste generated during the period of agreement specified by contract between such person and the property owner. This subsection shall not apply to temporary building or construction sites. All persons described in this subsection shall prominently display their business name, license number and telephone number on all vehicles used by such person and its employees during the entire performance of such contract including the disposal process.
