§ 23-2. Definitions.

  • For the purpose of this chapter, unless the context indicates otherwise, the following words and terms shall have the meanings ascribed to them in this section:

    Body or bodies shall mean the corporeal remains of a human after death.

    Burial charge shall mean the charge (fee) charged by the city to cover the city's administrative expenses incurred in connection with the burial of human remains at a city cemetery.

    Burial right shall mean the right to use a grave space for the interment, entombment, inurnment, or other disposition of human remains or cremated remains.

    Burial service or service shall mean any service offered or provided in connection with the final disposition, memorialization, interment, entombment, or inurnment of human remains or cremated remains.

    Care and maintenance shall mean the process of keeping a cemetery and its lots, graves, grounds, landscaping, roads, paths, parking lots, fences, vaults, crypts, utilities, and other improvements, structures, and embellishments in a cared-for and dignified condition, so that the cemetery does not become a nuisance or place of reproach and desolation in the community.

    Cemetery shall mean land used or intended to be used for the burial of the dead, other than such lands owned by fraternal organizations, churches or synagogues, or private family burial plots.

    City shall mean the City of Ocala

    City cemetery a cemetery that the city: (a) owns; or (b) maintains and secures pursuant to F.S. § 497.284.

    Cremated remains shall mean all the remains of the human body recovered after the completion of the cremation process, including processing or pulverization that leaves only bone fragments reduced to unidentifiable dimensions and my include the residue of any foreign matter, including casket material, bridgework, or eyeglasses that were cremated with the human remains.

    Cemetery superintendent shall mean the city engineer.

    Cemetery supervisor shall mean the director of the public works department.

    Disinter/disinterment shall mean removal of a dead human body from earth interment or above ground interment.

    Grave shall mean a space in the ground in a cemetery designated for use as a place used or to be used for burial of human remains in the earth.

    Human remains shall mean the body of a deceased human person for which a death certificate or fetal death certificate is required and includes the body in any stage of decomposition.

    Interment right shall mean the right of all owners to use cemetery grounds for the interment of dead persons. This interment right belongs to the owner of the cemetery lot, part lot, or grave space, and is subject to the rules and regulations contained in this chapter.

    Inurnment shall mean to enclose in an urn in the ground.

    Lot owner shall mean the owner of burial rights in a burial space.

    Marker shall mean any memorial stone complying with the requirements of this chapter laying flat on the ground, generally set flush with the level of the turf.

    Monument shall mean any memorial set upright or perpendicular to the grade consisting of two or more pieces joined and designed to be used as a single unit.

    Unclaimed body shall mean human remains that the Marion County Community Services Department has advised the city manager has been unclaimed or are not capable of identification, and for which there does not appear to be any charitable or other available source of financial or other assistance to pay for a grave or burial service.
