§ 22-354. Transfer of license.

  • (a)

    Generally. Except as provided in subsection (b) of this section, the MVL is nontransferable, and shall be used only by the person in whose name it is issued. Except for reasonable daily work breaks, the person in whose name an MVL is issued must be present on the immediate premises whenever goods or services are offered for business sale pursuant to the MVL. Exceptions will be recognized only for temporary transfer for medical reasons, as set forth in subsection (b) of this section.

    (b)

    Temporary transfer for medical reasons. Documentation of medical necessity shall be provided to the building official or his designee upon presentation of a physician's certificate that the MVL holder is unable to function as a mobile vendor. Prior to commencement of the temporary transfer, the substituting party shall provide the information and payments required by section 22-348 to the building official or his designee. In no event shall temporary transfer be allowed more than once, for a period of up to 90 consecutive days, within any one licensing year. The substituting party shall comply with all provisions of this division and shall pay any renewal fees which become due during the temporary transfer period.
