§ 22-31. Permit required; issuance; display.

  • (a)

    Required; issuance. No person shall engage in the occupation of fortuneteller, clairvoyant, palmist, phrenologist, character reader, spirit healer or any other similar occupation without a regulatory permit issued by the city. No such permit shall be issued until after the following conditions are fulfilled:

    (1)

    The applicant shall have been a resident of the state for at least two years and shall be a registered voter in the city.

    (2)

    The applicant shall establish good moral character and shall submit a Florida Department of Law Enforcement Criminal History Information Report obtained from the Ocala Police Department at the applicant's request and expense.

    (3)

    The application shall be presented to the chief of police, who shall make investigation and examination of the applicant and report the results thereof to the city council at its next meeting. The applicant shall pay a fee of $50.00 for the investigation, which shall not be refundable.

    (4)

    The city council shall consider the application and the report of the chief of police and order the permit either issued or denied. The order of the city council shall be made in triplicate, with the original given to the applicant and one copy retained by the clerk and one retained by the licensing official.

    (b)

    Display. The permit shall be displayed on the place of business. Failure or refusal so to do shall be prima facie evidence of engaging in business without a permit.

    (c)

    Obtaining permit by fraud. No person shall obtain any such permit by fraud or deceit.
