§ 122-1314. Fenced play area.

  • (a)

    A minimum of 45 square feet of usable outdoor play area must be provided for each child. Outdoor play area shall be calculated at the rate of 45 square feet per child in any group using the play area at one time. A minimum play area shall be provided for one-half of the licensed capacity. The play area must be fenced with no portion closer than 20 feet to any residential lot line, or closer than 50 feet to any public street. In addition, there shall be a ten-foot landscaped buffer between any portion of the fenced play area and any nonresidential lot line. This ten-foot buffer shall be designed in accordance with subsection 122-260(e).

    (b)

    A solid masonry wall shall be provided between fenced play areas and residential lot lines. However, vegetative screening may be substituted for the wall if, in the opinion of the building official and planning director, this vegetative screening furnishes equal protection against noise.

    (c)

    All outdoor play activities shall be conducted within the fenced play area, and no outdoor play activity shall be conducted before 8:00 a.m. or after 8:00 p.m.
