§ 118-103. Protection of canopy roads.

  • (a)

    In order to provide additional protection of aesthetic resources within the city, the following roadways are hereby designated as canopy roads:

    (1)

    S.E. Fifth Street from S.E. 11th Avenue to S.E. 15th Avenue.

    (2)

    S.E. 11th Avenue from Ft. King Street to S.E. 14th Street.

    (3)

    S.E. Seventh Street from S.E. 15th Terrace to S.E. 23rd Terrace.

    (4)

    N.E. Third Street from N.E. 12th Avenue to N.E. 15th Avenue.

    (b)

    All property within ten feet of the outside right-of-way line of the roadways designated in subsection (a) of this section shall be known as the canopy tree protection zone.

    (c)

    The canopy tree protection zone shall include trees located within the median of any divided street.

    (d)

    No person or agency shall cut, remove, trim or in any way damage any tree located within the canopy tree protection zone without obtaining a tree removal permit from the building department.

    (e)

    The city shall develop a schedule for annual inspection of all designated canopy roads. The city shall be responsible for trimming and de-mossing of all trees that comprise the canopy.

    (f)

    Road improvements for canopy roads shall be designed in such a way that no damage is done to the overall canopy.

    (g)

    Trees removed from these areas without obtaining the tree removal permit shall be replaced at a rate of two times the original diameter inches at 4½ feet above ground surface (DBH). New trees must be at least three inches in diameter at breast height (DBH).

    (h)

    Removal of trees damaged by disease, insects, fire, old age or other acts of God shall conform to sections 118-75 and 118-76.
