§ 114-11. Payment of costs of paving streets and installing water and sewer lines.

  • (a)

    No part of the cost of paving streets or installing water and sewer lines in any platted but undeveloped subdivision shall be paid by the city when these facilities are constructed to serve a development that requires the execution of a developer's agreement.

    (b)

    Where 50 percent or more of the frontage on a particular street one block or more in length is held by a single owner and is platted, subdivided or resubdivided, and proposed for simultaneous, continuous or phased development, the owner shall execute a developer's agreement with the city.

    (c)

    No building permit shall be issued for construction that is subject to a developer's agreement prior to the execution of a developer's agreement with the city guaranteeing installation of streets and water and sewer lines in accordance with chapter 58. Upon completion and acceptance of the improvements by the city, a front-foot charge for the pro rata costs of the improvements, based on actual costs for the improvements as certified by the owner's engineer and verified by the city engineer, shall be charged to other property owners fronting on the improved street and sewer and water lines. Existing development shall be charged immediately, and the funds remitted to the developer upon receipt. Undeveloped property shall be charged when development occurs, and the funds remitted to the developer upon receipt. If the later development requires a developer's agreement, the charges shall be for one-half the certified cost. Existing development and later development that does not require a developer's agreement shall be charged as specified in section 58-74.

    (d)

    Streets constructed to serve a development that does not require a developer's agreement shall be constructed in accordance with the criteria set forth in sections 58-71 through 58-74. Water and sewer line construction to serve such a development shall be financed and constructed in the normal manner prescribed by ordinance.
