§ 110-161. Temporary signs, real estate signs and construction signs.

  • (a)

    Real estate and construction signs. Real estate and construction signs shall be permitted under the following conditions:

    (1)

    Height, setbacks and spacing. Freestanding signs shall be:

    a.

    Set back a minimum of five feet from the public right-of-way.

    b.

    Set back a minimum of 25 feet from side property lines, or equidistant between side property lines.

    c.

    A maximum height of 12 feet.

    d.

    A minimum distance of 150 feet apart for each type sign on the parcel.

    (2)

    Sign area. The maximum sign area shall be as follows:

    (3)

    Construction signs. Construction signs shall not be erected more than 60 days prior to the beginning of construction, and shall be removed within ten days from issuance of the first certificate of occupancy for that development. Such signs shall be removed immediately if construction has not begun after 60 days, or if construction is halted thereafter for a period of more than 30 days. On properties of ten acres or more, preconstruction announcement signs may be permitted for extended periods. Subcontractor and other additional signs of three square feet or less shall be permitted in addition to total sign area, and shall be affixed to or be immediately adjacent to the main sign structure. Additional signs exceeding three square feet shall be counted toward total sign area.

    (4)

    Removal of real estate signs. Real estate signs, other than "for lease" signs, must be removed within ten days after closing.

    (b)

    Temporary signs. Temporary signs for public or private nonprofit special events, or special events not related to the primary use of the property, shall be permitted by the building official for a period covering the duration of the event and advance publicity not to exceed two weeks. Such temporary sign shall not exceed 32 square feet for each frontage and shall not be illuminated.

    (c)

    Temporary pennants, banners, balloons, commercial flags or streamers. Temporary pennants, banners, balloons, commercial flags or streamers may be erected in B-l, B-1A, B-2, B-2A, B-4, B-5, M-1 and M-2 zones for the purpose of advertising grand openings, special sales and other temporary events. Such temporary pennants, banners, balloons, commercial flags or streamers shall be permitted on any single property for a period not to exceed two weeks and not more often than four times a year.

    (1)

    The pennants, banners, balloons, commercial flags, streamers or combination thereof shall not exceed 50 percent of the freestanding signage allowed for the property in question.

    (2)

    Such pennants, banners, balloons, commercial flags or streamers shall be attached to a building or other secure anchor in a manner that withstands the wind pressure specified by the applicable building code.

    (3)

    Permits shall be required for such pennants, banners, balloons, commercial flags or streamers as outlined in article II, division 2 of this chapter.
