§ 10-151. General requirements.

  • Each adult use establishment shall, regardless of whether it is licensed, observe the following general requirements:

    (1)

    Conform to all applicable building statutes, codes, ordinances and regulations, whether federal, state or local.

    (2)

    Conform to all applicable fire statutes, codes, ordinances and regulations, whether federal, state or local.

    (3)

    Conform to all applicable health statutes, codes, ordinances and regulations, whether federal, state or local.

    (4)

    Conform to all applicable zoning regulations and land use laws, whether state or local.

    (5)

    Keep the adult use license posted in a conspicuous place at the adult use establishment at all times, which license shall be available for inspection upon request at all times by the public.

    (6)

    Opaquely cover each non-opaque area through which a person outside the establishment may otherwise see inside the establishment.

    (7)

    Maintain a continuously updated compilation of the records required in section 10-131 and, on the first Monday of every month, provide the building department with an update of those records for all persons who are or have been employees at the establishment since the first Monday of the previous month, and their positions.

    (8)

    Insure that the requirements or prohibitions contained in Code sections 6-8 and 42-9 are complied with by all adult use establishment employees.

    (9)

    Insure that no employee or customer engage in specified sexual activity or display a specified anatomical area to any other employee or customer while in an adult use establishment.
