§ 10-101. Responsibilities of building department.

  • (a)

    The building department is responsible for granting, denying, revoking, renewing, suspending and cancelling adult use licenses for proposed or existing adult use establishments and for ascertaining whether a suspected adult use establishment is licensed or whether a licensed establishment complies with or is complying with this article. The building department may assist law enforcement in its investigative responsibilities and may initiate investigations and issue citations in their areas of responsibility. In making determinations relating to noncompliance, initiating investigations, and issuing citations pursuant to this chapter, the building department shall consider only the specific requirements of this chapter.

    (b)

    Any employee of the building department who is authorized by the building official, shall, at any reasonable hour, when the building department has reasonable cause to believe that a violation of this article may exist, have access to and shall have the right to inspect the premises of all licensees under this article for compliance with any or all of the applicable codes, statutes, ordinances and regulations in effect in the city. Such employee shall require strict compliance with the provisions of this article. Reports of violations shall be reported to the building department.
